1982 Anayasasına göre kuvvet kullanımında yetkili organlar

Abstract

Kuvvet kullanımı devlet için hayati konulardan biridir. Bu nedenle kuvvet kullanımında yetkili organlar 1982 Anayasası tarafından düzenlenmiştir. Ancak bu düzenlemeler açık ve net olmadığı için yeni tartışmaları da gündeme getirmiştir. Bu tartışmaların ilkini yasama ve yürütme arasındaki yetki tartışması oluştururken ikincisini yürütmenin kendi içindeki yetki kullanımı tartışması oluşturmaktadır. Özellikle Cumhurbaşkanı’nın halk tarafından seçilmesi ilkesinin getirilmiş olması bu tartışmayı arttırmaktadır.

Use of force is one of the vital subjects for the state. Because of this fact, institutions that have the right to decide to use force are arranged by Constitution of 1982. However new discussions appeared because the arrangements were not clear and absolute. First subject is discussion of power between legislative and executive. Second one is usage of power among executive institutions. Especially the principle that brings the election of the president of republic by public votes promotes the discussion.
